 As part of the succession plan the elder Falwell established prior to his death, Jerry Jr. was to be given the responsibility of Liberty University while Jerry Sr.'s other son, Jonathan Falwell, inherited the pastorate at Thomas Road Baptist Church. The decisions were rooted in each's personality: Jerry Jr. had aggressive business instincts, and Jonathan was more charismatic and committed to ministry. The succession plan came into place at the time Jerry Sr. passed away in 2007. The letter, signed by Andy Levin and Jamie Raskin to Betsy DeVos, claimed that Falwell was the only person who prevented students from writing critical columns about the president. Reuters released a story that claimed that Falwell was often watching Falwell perform sexual acts with his wife. The following day, on the 24th of August It was reported by Reuters that Falwell had resigned from Liberty University. [15] Falwell denied the allegations immediately, while Liberty said that talks were still ongoing. [14][15(15) Falwell immediately denied the claim, and Liberty University claimed that negotiations were still ongoing. Liberty also opened an investigation into Falwell's past involvement in the school's finances as well as real property. Transactions that directly benefit an individual may jeopardize Liberty's tax-exempt status. [9] In October 2020, Falwell sued Liberty University for damaging his reputation, but in December 2020 , the university dropped the lawsuit On April 15 2021, Liberty University sued Falwell for damages in the amount of $40 million in breach of contract and violation of fiduciary duty. In November 2021 Falwell renewed his lawsuit for defamation against Liberty University.
